1. Who We Are

Nexkir is operated by Hainan Huawen Technology Co., Ltd. (海南华文技术有限公司), with registered domain nexkir.ai. We are the data controller for personal data you provide. Payments are processed by Waffo, our Merchant of Record, which independently handles payment data.

2. Data We Collect

• Account: email, nickname, hashed password, billing country, language, age-verification state, consent records.
• Usage: messages with AI companions, group activity, created agents, and settings.
• Memory & embeddings: only if you enable long-term memory. We may derive structured memories and vector embeddings from conversations to personalize companions. Off by default.
• Voice: audio you send is transcribed to text for processing; synthesized audio is generated for replies. Voice minutes are metered.
• Region & security logs: originating IP/region (for access controls), device fingerprint, and access-denial logs.

3. Legal Bases

We process data on the bases of contract performance (to provide the Service), legitimate interests (safety, fraud prevention, region enforcement), and consent (long-term memory, optional AI-sharing, marketing). Where consent is required, you may withdraw it at any time from your profile.

4. How We Use Data

• Generate companion responses and (with consent) maintain personalization memory.
• Enforce age and region restrictions; detect and prevent abuse, CSAM, and self-harm.
• Operate, secure, and improve the Service; produce aggregate, de-identified analytics.
• Process payments via Waffo; we do not store full card data.

5. Sharing

• Waffo (Merchant of Record): payment and billing data necessary to complete transactions and handle tax/chargebacks.
• AI model subprocessors: conversation text is sent to the model provider you are configured with, solely to generate replies.
• Authorities: CSAM, self-harm, and lawful requests are reported as required.
• We do not sell personal data.

6. International Transfers

Data may be processed outside your country of residence. Where required, we rely on the Merchant of Record and standard safeguards for cross-border transfers. The Service is not offered to the EU/EEA/UK, limiting EU personal data processing.

7. Retention

We keep account and usage data while your account is active and for a limited period afterward for safety and legal compliance. Deleted accounts are erased or anonymized. Access-denial logs are retained for compliance and dispute handling.

8. Your Rights

• Access / export: request a copy of your data from your profile.
• Delete: delete your account and associated personal data anytime.
• Memory control: review, export, or clear companion memories; disable long-term memory.
• Object / restrict: where processing is based on legitimate interests.

9. Children

The Service is strictly 18+. We do not knowingly collect data from minors. If we learn of such data, we delete it and may report per child-safety law. Contact: childsafety@nexkir.ai.

10. Changes

We may update this Policy; material changes are announced in-app or by email.
