Terms of Service

1. Acceptance

By creating an account or using Nexkir ("the Service"), you agree to these Terms. If you do not agree, do not use the Service. The Service is provided for personal, non-commercial use by adults.

2. Eligibility

• You must be at least 18 years old. Age is locked at registration and cannot be changed later.
• The Service is not available in the European Union, the European Economic Area, the United Kingdom, or Switzerland. Access from these regions is blocked and accounts with these billing countries are rejected.
• You are responsible for any age or region misrepresentation; we may suspend or terminate accounts that violate eligibility.

3. Accounts

You are responsible for safeguarding your credentials and for activity under your account. Notify us at support@nexkir.ai of any unauthorized use. You may export or delete your account data from your profile at any time.

4. AI Companions Are Not People

• Every AI character, message, and voice output is generated by software. Nothing an AI companion says is the opinion, advice, or statement of a human being or of the operator.
• AI companions may not provide medical, legal, or financial advice. If you are in crisis, contact local emergency services.
• You can stop any AI interaction at any time using the in-app "stop" control. AI behavior changes are announced in advance where material.

5. User Content & Conduct

You retain ownership of content you submit. By submitting content you grant us a limited license to process it to operate the Service (including, with your consent, generating companion memories and embeddings). You agree not to:

• Upload, generate, or share any child sexual abuse material (CSAM), content that sexualizes minors, or self-harm instructions. These are blocked, reported to authorities, and may freeze creator earnings.
• Harass, defame, impersonate, or infringe others' rights.
• Attempt to circumvent region, age, or safety controls (including via VPN).
• Use the Service for unlawful activity in any jurisdiction.

6. Creator Studio

Creators may publish AI agents subject to content review (machine pre-screen, then human review where confidence is low). A safety score reflects violations; severe or CSAM/self-harm violations can freeze revenue. Behavior versions are immutable once announced; non-safety changes are announced at least 7 days in advance.

7. Paid Services

• Payments are processed by Waffo, our Merchant of Record (MoR), which is the seller of record and handles localized sales tax, compliance, and chargebacks.
• Subscriptions auto-renew until cancelled. Voice packs are consumable and do not auto-renew.
• Prices and taxes are shown at checkout and may vary by billing region.
• Refunds follow Waffo's policy and applicable consumer law. Where a paid user is later found ineligible by region, we will process a refund.

8. Virtual Items

Voice minutes and similar consumables have no cash value, are non-transferable, and expire as stated at purchase. We may adjust pricing with notice.

9. Termination

We may suspend or terminate your account for Terms violations, legal/regulatory reasons, or extended inactivity. You may delete your account at any time; we will delete or anonymize your personal data per our Privacy Policy.

10. Disclaimers & Liability

The Service is provided "as is" without warranties. To the maximum extent permitted by law, the operator is not liable for indirect or consequential damages. Nothing here excludes liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify the operator against claims arising from your misuse of the Service or violation of these Terms.

12. Changes & Contact

We may update these Terms; material changes are announced in-app or by email. Continued use after changes means acceptance. Contact: legal@nexkir.ai.
